1. Introduction
JINDHAMMA Tattoo Studio (“JINDHAMMA,” “we,” “us,” or “our”) respects the privacy of information relating to your health, skin, tattoo eligibility, and healing.
This Consumer Health Data Privacy Policy explains how JINDHAMMA collects, uses, and shares consumer health data and how you may exercise your rights under the Washington My Health My Data Act.
Consumer health data generally means personal information that is linked or reasonably linkable to you and identifies your past, present, or future physical or mental health status.
This policy applies specifically to consumer health data. For information about JINDHAMMA’s general personal-information practices, please review the separate Privacy Policy.
This policy is a privacy notice and does not itself constitute consent. When affirmative consent is required, JINDHAMMA will request it separately.
2. Categories of Consumer Health Data Collected
In connection with tattoo services, JINDHAMMA may collect consumer health data that you voluntarily provide or that is reasonably necessary to evaluate or provide a tattoo service you request.

Medical conditions relevant to tattoo safety, including diabetes, cancer, autoimmune conditions, heart conditions, sarcoidosis, hemophilia, or other bleeding or clotting conditions

JINDHAMMA does not intentionally collect genetic data, biometric identifiers, or precise location information for purposes of providing tattoo services.
3. Purposes for Collecting and Using Consumer Health Data
JINDHAMMA may collect and use consumer health data to:

Determine whether consultation with a qualified healthcare professional or written medical clearance may be appropriate

JINDHAMMA does not use consumer health data for targeted advertising, third-party marketing, or automated health profiling.
JINDHAMMA does not diagnose or treat medical conditions.

5. Collection and Consent
JINDHAMMA collects consumer health data:

With your affirmative consent when consent is required; or

To the extent reasonably necessary to provide a tattoo service or other product or service that you requested, as permitted by applicable law
When affirmative consent is required, JINDHAMMA will request consent through a clear, separate action rather than through general Terms of Use or an unrelated agreement.
A request for consent will describe the categories of consumer health data involved, the purpose of collection or sharing, the categories of entities that may receive the data, and how you may withdraw consent.
You may withdraw consent from future collection or sharing of your consumer health data as described below. Withdrawal does not affect processing that occurred before consent was withdrawn.
If JINDHAMMA does not have information reasonably necessary to evaluate tattoo safety or provide the requested service, JINDHAMMA may be unable to accept, evaluate, schedule, or proceed with that service.
6. Categories of Consumer Health Data Shared
JINDHAMMA does not sell or offer to sell consumer health data.
JINDHAMMA does not share consumer health data with third parties or affiliates for their own advertising, marketing, or independent commercial purposes.
In the ordinary course of business, JINDHAMMA does not share consumer health data with third parties or affiliates as “sharing” is defined under the Washington My Health My Data Act.
JINDHAMMA may allow processors acting on its behalf to access or process limited consumer health data when reasonably necessary to operate forms, communications, or business records and provide the service you requested. Such processing is limited to the disclosed purposes.
If JINDHAMMA begins sharing consumer health data in a manner requiring disclosure or consent under applicable law, this policy will be updated and any required consent will be obtained before the sharing occurs.

Depending on the service used, these processors may process the categories of consumer health data described in Section 2 only to the extent reasonably necessary to provide their services to JINDHAMMA.
Access to consumer health data is limited to JINDHAMMA and processors or contractors for whom access is reasonably necessary to provide the requested service or carry out the purposes disclosed in this policy.
8. Your Consumer Health Data Rights
Subject to applicable law, you may request to:

9. How to Submit a Consumer Health Data Request

Describe the right you wish to exercise and provide enough information for JINDHAMMA to reasonably identify you and understand your request.
JINDHAMMA may request additional information reasonably necessary to authenticate your identity and the request.
Please do not send your Social Security number, complete payment-card number, a copy of your government-issued identification, or other unnecessary sensitive information.
JINDHAMMA will respond without undue delay and generally within 45 days after receiving your request.
When reasonably necessary due to the complexity or number of requests, the response period may be extended once by an additional 45 days. If an extension is necessary, JINDHAMMA will provide notice within the initial response period and explain the reason for the extension.
Information provided in response to an eligible request will be provided free of charge up to twice annually per consumer.
Where permitted by law, JINDHAMMA may charge a reasonable fee or decline to act on a request that is manifestly unfounded, excessive, or repetitive.

Withdrawal applies to future collection or sharing, subject to applicable law. It does not affect processing that occurred before consent was withdrawn.
If consumer health data is reasonably necessary to evaluate or safely provide a tattoo service you requested, withdrawing consent or declining to provide necessary information may prevent JINDHAMMA from evaluating or providing that service.
11. Deletion Requests
You may request deletion of consumer health data concerning you.
When a valid deletion request is received and authenticated, JINDHAMMA will process the request as required by applicable law.
Where required, JINDHAMMA will also notify applicable processors, contractors, affiliates, or third parties that received the consumer health data of the deletion request.
If consumer health data subject to a valid deletion request is stored in archived or backup systems, deletion from those systems may be delayed as permitted by law and may take up to six months after authentication of the deletion request.
12. Appeals
If JINDHAMMA refuses to take action on your consumer health data request, you may appeal the decision.

JINDHAMMA will provide a written response within 45 days after receiving the appeal, including an explanation of the action taken or not taken.
If the appeal is denied, JINDHAMMA will provide information about how you may contact the Washington State Attorney General to submit a complaint.
13. Additional Categories or Purposes
JINDHAMMA will not collect, use, or share additional categories of consumer health data not disclosed in this policy without first updating the applicable disclosure and obtaining affirmative consent when required by law.
